BENJAMIN, Fla. — Eli Lilly and Co.’s anti-smoking drug Zyban has hit the shelves, but its maker may be able to extend its exclusivity on the drug in a legal case.
Bayer Pharmaceuticals, the world’s largest drug maker, has been permitted to sell the drug in Ireland for $50 per month for three years. Zyban is currently under final marketing approval in the U. S. and Europe.
“This is an important case to bring to market,” said Zyban’s U. attorney in Ireland, Michael J. FitzGerald. “The company has been very successful with its patients.”
The drug was launched in France in 1998 and Germany in 2003. Eli Lilly had previously marketed the drug as a treatment for depression and other psychiatric disorders, but this has changed since Zyban was approved for the treatment of smoking cessation in the United States in 2008. The company also announced in March 2015 that it would be allowed to sell the drug for one year for a low price.
Eli Lilly’s Zyban has also been the subject of an injunction from the U. Supreme Court against the company from October 15, 2015 to January 31, 2016. The high court ordered the company to stop marketing the drug in Ireland. The judge also ruled in Zyban’s favor.
The company did not disclose how much Zyban was expected to cost to it in the United States, but the price has already been reported in the press release. Eli Lilly also declined to comment on the price. The company had previously marketed the drug in Europe for three years.
The Zyban patent was set to expire in 2012, and the drug could now be launched in other countries as well. A study of the potential benefits of Zyban for smoking cessation showed that it had the potential to “enhance treatment adherence for quitting smoking by promoting the ability to successfully manage and stop smoking by reducing cravings, withdrawal symptoms, and the occurrence of withdrawal-related harm.”
In 2016, Eli Lilly filed a patent infringement action against the company alleging that the patent for Zyban was invalid.
The patent covers the drug’s mechanism of action, which includes altering levels of certain chemicals in the brain to cause a patient’s cravings. The company also filed a lawsuit against the company alleging that it is infringing upon the patent.
The lawsuit is filed on behalf of Eli Lilly and claims that Lilly had a duty to warn about the dangers of smoking cessation, including Zyban. The company also alleges that Zyban is dangerous for patients due to its smoking cessation effects.
The company also seeks to enjoin the company from marketing the drug to people who are addicted to nicotine and also seeks to award $2 million to the plaintiff in a motion for summary judgment. The motion for summary judgment is filed after the pharmaceutical company has had an opportunity to assess the benefits and risks of its product and the trial process and after considering the facts of the case.
Lilly’s Zyban patent has already been challenged and the case is scheduled to be heard in a court proceeding in Ireland.
